These Terms of Use govern your use of Out of Place: Think & Move (the "App") and related support services provided by NoviDoc Games ("we", "us", or "our"). The publisher’s identity is also shown on the App’s store listing. By using the App, you agree to these Terms. If you do not agree, stop using the App. Our Privacy Policy explains how information is handled.
1. Using the game
We grant you a limited, personal, non-exclusive, non-transferable license to install and play the App for lawful, non-commercial entertainment, subject to these Terms and the rules of the store through which you obtained it. You must meet any applicable store or platform eligibility requirements. If you cannot legally agree to these Terms independently, a parent or legal guardian must authorize your use where required by law.
The current App includes a 50-level puzzle campaign with progression, local scores, star ratings, tutorials, and story scenes. Access to later levels depends on gameplay progress. The App currently has no advertisements, in-app purchases, or subscriptions. Any download price is displayed and processed by the distributing store; its payment and refund rules apply, together with your mandatory consumer rights.
2. Saves and availability
Progress and preferences are saved locally. The App does not offer a NoviDoc account or guarantee cloud backup or transfer between devices. Clearing app data, resetting scores, reinstalling, or changing devices may remove local records. You are responsible for any device backup options you choose to use.
We may update the App, adjust levels or features, and address technical problems. Online features depend on your device, connection, and third-party availability. We do not promise uninterrupted operation or indefinite availability of every feature. Any changes or discontinuation remain subject to applicable law and your statutory rights.
3. Leaderboards and platform services
Where configured, leaderboards use Apple Game Center or Google Play Games. Signing in, score submission, profile visibility, and rankings are governed by that provider’s terms and settings. The App may attempt to connect when the main menu opens and synchronize your best completed score. Core gameplay can continue without a successful connection. Platform accounts and passwords are managed by Apple or Google, and you must follow their account rules.
Scores, stars, and other gameplay results are for entertainment and ranking only. They have no monetary value and cannot be redeemed for cash, cryptocurrency, or real-world prizes. The App does not offer real-money gambling.
4. Prohibited conduct
- Cheating, manipulating scores, or using unauthorized automation to interfere with fair play.
- Exploiting vulnerabilities, disrupting services, or accessing systems or information without authorization.
- Distributing modified copies, selling access, or copying App content without permission, except as allowed by law.
- Infringing intellectual property rights or violating applicable laws or platform rules.
5. Intellectual property
The App’s code, artwork, characters, audio, branding, and other materials are owned by us or our licensors and are protected by applicable law. These Terms give you permission to use the App, not ownership of its content. Third-party and open-source materials remain subject to their applicable licenses.
6. Privacy and external services
The App uses Firebase Analytics for gameplay analytics and Sentry for crash and performance reporting, as described in the Privacy Policy. External websites, app stores, and game services are operated by their respective providers and may impose their own terms. We are responsible for our obligations under applicable law, but do not control those independent services.
7. Ending use or restricting access
You may stop using and uninstall the App at any time. Where technically possible and permitted by law, we may restrict access to online features if you materially violate these Terms or misuse the service. Removing the App does not necessarily delete information already held by platform providers; see the Privacy Policy for deletion requests and choices.
8. Warranties and liability
To the extent permitted by law, the App is provided "as is" and "as available", without additional promises about uninterrupted operation, compatibility with every device, or freedom from errors. Nothing in these Terms excludes warranties, remedies, or consumer protections that cannot lawfully be excluded.
To the extent permitted by law, we are not liable for indirect, incidental, or consequential losses arising from use of the App. This limitation does not exclude or restrict liability for fraud, willful misconduct, death or personal injury caused by negligence, or any other liability that cannot be limited under applicable law.
9. Changes to these Terms
We may revise these Terms when the App or applicable requirements change. The updated version will show a new date, and we will provide further notice or request agreement where required. Changes do not remove rights that arose before they took effect. If you do not agree to an applicable update, stop using the App.
